Terms of use.
The rules of the road for using PlanOptica. Written in plain language; if anything is unclear, write to us at hello@planoptica.com.
Last updated May 2026.
The short version
- Use the product for plan research. Don't scrape it, share seats, or resell the data as a feed.
- Pay for what you use; cancel anytime. Annual plans prorate refunds for unused full months at our discretion.
- PlanOptica is research, not advice. Verify any number against the source filing before quoting it to a client.
- We can't promise the service is perfect, and we aren't liable for indirect or consequential loss from your use of it.
The service
PlanOptica is a research tool that organizes the public Form 5500 universe into a searchable, peer-ranked interface, plus a custom-analysis service for questions the search interface can't answer. Access is provided on a subscription basis; some surfaces are free.
We work continuously to add fields, schedules, and analytics. The list of features available to you may change as the product evolves; we will not remove features you're actively paying for without 30 days' notice.
Your account
- You're responsible for keeping your sign-in credentials secure and for activity under your account.
- Each seat is for one person. If your team grows, add a team member rather than sharing one login.
- You must be at least 18 years old to hold an account.
- If you sign up for a team account, the person who creates it has admin rights over the team's seats, billing, and saved content. The team admin agrees to these terms on behalf of the team.
Acceptable use
The Form 5500 data is public; the curated dataset, the indexes, the peer benchmarks, the prospect flags, and the user interface are not. While using the service, you agree not to:
- Scrape, crawl, mass-export, or programmatically harvest the curated dataset, including by automating browser sessions.
- Resell, redistribute, or sublicense the curated dataset as a data feed, API, or product offering.
- Reverse-engineer the prospect-flag rules, peer-cohort definitions, or other proprietary computations.
- Probe, scan, or test the vulnerability of the service without prior written permission.
- Use the service to build a competing product, or to train a machine-learning model on the curated dataset.
- Misrepresent your affiliation with PlanOptica or use the brand to mislead third parties.
Reasonable in-product use, including CSV exports of search results within published row limits, is fine and encouraged. If you want to use the data outside the product in ways the limits don't cover, ask us.
Billing and subscriptions
- Paid subscriptions are billed monthly or annually in advance, as you choose at checkout. Prices, seats, and feature scope are described on the pricing page.
- You authorize us, through Stripe, to charge the payment method on file for the subscription, taxes, and any one-time charges (additional seats, custom analysis engagements).
- Cancellation. You can cancel anytime from your account; the service continues through the end of the current paid period. We do not auto-prorate refunds for unused days on monthly plans. For annual plans, refunds for unused full months are at our discretion; we are reasonable about it.
- Price changes. We may change prices for renewal periods with at least 30 days' email notice. Your current paid period is unaffected.
- Failed payments. If a charge fails, we'll retry and email you. Service is suspended after a grace period; data is retained per the privacy notice retention schedule.
- Taxes. Prices listed exclude applicable sales, VAT, or GST, which are added at checkout where required.
Free trials
Where offered, trials run for the period stated at checkout (no card on file unless explicitly noted). You get one trial per team. If you don't convert, the account drops to the free tier; saved searches and exports made during the trial remain accessible at the free tier's scope.
Custom analysis engagements
Custom analysis is a services line, not a subscription feature. Each engagement is governed by a separate statement of work that lists the deliverable, timeline, and price. The terms here apply to the engagement except where the SOW says otherwise.
Deliverables are licensed to your organization for internal use. Onward redistribution requires our written consent.
Intellectual property
The service, including the user interface, the curated dataset, the indexes, the peer benchmarks, the prospect flags, the documentation, and all related software, is the property of PlanOptica or its licensors. Subject to these terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the service for your internal business purposes.
Feedback is welcome. If you send us suggestions, you grant us a non-exclusive, royalty-free license to use the feedback to improve the product. You don't lose any rights to your underlying ideas.
Your data and content
Saved searches, saved plans, notes, and exports created in your account belong to you. We process them on your behalf to operate the service.
Privacy of personal data is covered separately in our privacy notice.
Public filing data
The Form 5500 records inside the product come from public filings published by the U.S. Department of Labor. Those filings are not your data; they are public record about plan sponsors and service providers. The curated form in which we present them (joins, normalizations, peer ranks, flag computations, schema) is ours.
Not advice
PlanOptica is research, not legal, tax, accounting, fiduciary, actuarial, or investment advice. Nothing in the product is a recommendation to buy, sell, or hold a security or to engage any service provider. Verify numbers against the underlying filing before relying on them in a client-facing context, and consult a qualified professional for advice tailored to your situation.
Service as-is
We work hard to keep the data accurate and the service up. We can't promise either is perfect. To the fullest extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Form 5500 data is sourced from the Department of Labor; we do not warrant the accuracy, completeness, or timeliness of that underlying data. Errors in source filings flow through to the product.
Limitation of liability
To the fullest extent permitted by law, neither PlanOptica nor our licensors will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or loss of data, arising out of or in connection with your use of the service. Our total aggregate liability for any claim arising out of or in connection with the service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars, whichever is greater.
Some jurisdictions don't allow these limitations; in those, the limits apply only to the maximum extent permitted.
Termination
You can close your account at any time from your profile. We may suspend or terminate access if you materially breach these terms, with notice where reasonable. On termination, the licenses granted to you end and your rights to access the service stop. Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, governing law, and these survival provisions) survive termination.
Changes to these terms
We may update these terms as the product and business evolve. Material changes are announced in the product or by email at least 30 days before they take effect; small clarifications post with a revised "Last updated" date. Continued use after a change takes effect is acceptance of the change. If a change is unacceptable, your remedy is to close your account.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision is held unenforceable, the rest stays in effect. A failure to enforce a right is not a waiver of that right.
